Everything You Need to Know About CBD Oil in Michigan

CBD oil products have gained popularity in Michigan and across the nation because of the potential benefits they offer consumers. Additionally, CBD products do not come with the psychoactive effects associated with marijuana.

However, before you simply go out and buy some CBD oil, you need to know more about the kinds of products out there, the laws associated with CBD oil in Michigan, and some tips for finding the best CBD oil products for your needs.

What Is CBD Oil?

Cannabidiol (CBD) is the second most popular active compound, or cannabinoid, in the cannabis plant. Cannabidiol oil aka CBD oil comes from the extract of the hemp plant. In contrast to THC, the psychoactive compound that causes someone to get ‘high,' CBD has no mind-altering effects. However, it may provide several health benefits such as helping people cope with chronic pain and joint pain.

CBD interacts with the body's cannabinoid receptors, which are part of the endocannabinoid system. Two receptors are typically present in the body. One is mostly in the brain and the other in the immune system. CBD stimulates the receptors helping the body to create its own cannabinoids, which scientists believe leads to health benefits people report.

Those who want to reap the benefits of CBD can ingest the oil by using a wide array of CBD products from edibles like CBD gummies to capsules to topical creams to CBD vape oil. The exact CBD dosage varies among products, so those new to CBD need to investigate products carefully to find out what fits their needs.

Is CBD Legal in Michigan?

All forms of marijuana and hemp are legal in Michigan, including medical marijuana and recreational marijuana, so no need to worry about legality if you want to use CBD products. You should, however, avoid CBD products with high THC content if your job subjects you to drug testing.

Michigan Hemp Legislation

Michigan allows those who hold a license to grow, process and handle industrial hemp as of January 2019 when the state enacted the Michigan Industrial Hemp Research and Development Act of 2018. The Bureau of Marijuana Regulation and the Michigan Department of Agriculture also warn that any products derived from industrial hemp must be approved by the U.S. Food and Drug Administration (FDA) if they will be added to food, drinks, animal feed, or marked as a dietary supplement. This includes CBD oil. The FDA has not approved CBD for any of these purposes, so it's illegal to add CBD to the products listed above.

There are three exceptions to this rule:

  • Hulled hemp seed
  • Hemp seed protein
  • Hemp seed oil

Are There Laws About CBD Possession in Michigan?

Currently, there are no limits for possession of CBD in Michigan, except those who buy CBD oil and other hemp products must be age 21 or older.

What Is Required to Sell CBD in Michigan?

Those who want to sell CBD in Michigan need to apply for a processor/handler license through Michigan's Industrial Hemp Ag-Pilot Program. Only those without felony drug convictions in the past ten years are eligible. The license application must include maps for locations where the person will sell or market CBD as well as a fee of $1,350 as of October 2020.

Labeling and Marketing CBD Products in Michigan

Rules about labeling and marketing CBD products fall under federal law. As mentioned above, it's illegal to market and sell these products under federal law, but states typically follow labeling requirements set forth in the Food, Drug, and Cosmetic Act, which requires four basic elements:

  • A statement that indicates what the product is
  • The net weight of the product
  • An ingredient list
  • Contact information for the manufacturer, packer, or distributor

Other aspects of labeling and marketing CBD products in Michigan include using a scannable barcode or QR code, an FDA warning statement, and refraining from making any health claims about CBD.

What Types of CBD Oil Can You Buy in Michigan?

You can find all three major types of CBD oil in Michigan: full spectrum, broad spectrum, and isolate. Full spectrum CBD oil contains all the compounds naturally found in the hemp plant, which does include some THC that must fall below 0.3%. Broad spectrum CBD oil is similar to full spectrum, except the process to remove the oil from the plant includes removing all THC, while keeping terpenes and the rest of the potentially beneficial cannabinoids. Isolate is pure CBD without any other cannabinoids, which means there is absolutely no THC in the product.

Finding High-Quality CBD Products in Michigan

You can find high-quality CBD products in Michigan at CBD stores and health shops if the oil comes from the hemp plant. If you are looking for high-quality CBD oil derived from the cannabis plant, you need to go to a licensed retailer.

What to Look for When Buying CBD in Michigan

It's best to speak with a knowledgeable employee at a store who can help you evaluate your needs and make product suggestions for you, but you might not always find the help you need. If you’re buying CBD oil online, you can use the CBD Oil Review site to find CBD brand reviews, CBD buyer guides, medically reviewed content, and CBD coupons.

Remember, the most reputable CBD oil producers list the following information on their products:

  • The amount of CBD per serving
  • Supplement facts and ingredients
  • Net weight
  • Name of manufacturer/distributor
  • Suggested use
  • Date produced or batch code
  • Whether a product is full spectrum, broad spectrum, or isolate

While all the above information is important, you need to know the type of oil you are buying. If you use a full-spectrum CBD oil product, you will have THC in your system and could potentially fail a drug test. Isolates guarantee you won't have THC, but you also lose the benefit of all the other cannabinoids in hemp CBD oil. For most people, broad spectrum oil offers the most potential benefits without the mind-altering impact of THC.

Finally, you should ask for information about the product certificate of analysis (COA). The COA shows information about third-party lab testing and reveals the exact amounts of specific compounds and allows you to verify that impurities have been removed from the oil.
