Everything You Need to Know About CBD Oil in Washington
The hemp plant harbors many potential benefits when cultivated and processed cleanly. While the euphoria cannabis is known for comes from the well-known component THC, the easing of physical symptoms is more closely related to the non-intoxicating cannabinoid, CBD. CBD aka CBD oil is oil extracted from industrial-grade hemp plants with high CBD and low-to-zero THC content.

What is CBD oil?
CBD oil is a natural compound called a cannabinoid that is extracted from hemp plants. CBD is present in all cannabis family plants whether they have been cultivated for textile fibers or marijuana flowers. CBD oil is extracted from the leaves, stems, and flowers of a hemp plant.
Full spectrum CBD oil is most like what comes out right after extraction. It's full of all the natural terpenes and cannabinoids that are part of the hemp plant. Those terpenes and cannabinoids are what make the CBD oil full spectrum, and each growth of hemp offers a different combination, and therefore balance of physical effects.
Refined CBD oil is what leads to broad spectrum CBD oil and CBD isolate. Broad spectrum CBD oil has been refined to remove the THC, making it safe (only proven with testing) for those who cannot have THC in their job. In the process, some of the terpenes and other cannabinoids are also diminished.
CBD isolate has been refined down to just CBD without any other cannabis plant components. It may be in a carrier oil as the natural plant oils have been removed.
CBD Oil vs Hemp Seed Oil
When discussing CBD oil, remember that there are two different types of “hemp” oil. CBD oil is made from one of the following or a combination:
- Hemp stalks
- Hemp leaves
- Hemp stems
- Hemp flowers
Hemp seed oil is a different product made from pressing the seeds of a hemp plant. Hemp seed oil is considered an edible and a beauty product and has been for decades. Hemp seed oil contains no CBD, though both could be called “hemp oil” generically and have been, to some confusion.
Is CBD legal in Washington?
YES, CBD is perfectly legal in Washington.
The 2018 US Farm Bill defined legal non-marijuana hemp products as containing less than 0.3% THC measured in dry weight. By doing this, they removed low-THC hemp (and its products) permanently from the Controlled Substances list. This, as a result, made it legal to process hemp oils including CBD oil for commercial and industrial use. Naturally, Washington and the national industry began exploring the new potential market.
Washington began hemp cultivation before the 2018 Farm Bill, under the provisions for pilot programs in the 2014 Federal Farm Act. Currently, it is legal to own, grow, cultivate, and process CBD products- provided the THC concentration never tops 0.3 percent.
What the FDA Says About CBD Edibles & Beverages
The 2018 bill preserves the FDA right to ingredient regulation for hemp and hemp extracts like CBD oil. During the margin period before an FDA ruling, many CBD edible and beverage products were developed then sold to the public. In mid 2019, the FDA officially banned CBD oil and concentrate from consumable products. Commercial brands are not approved to sell food or drink CBD products.
The case is different for hemp seed oil, a similar product made from pressing the seeds of hemp instead of the stems, leaves, and flowers. Hemp seeds have been approved by the FDA for three different types of consumption. Hemp seed husks, protein powder, and pressed hemp seed oil are all FDA approved for consumption and beauty products, meeting the usual FDA standards.
Are there laws about CBD possession in Washington?
CBD is no longer considered a controlled substance in the state of Washington. Owning CBD for your own use and selling CBD products– within legal product guidelines– are all legal. There are no current laws against possession of CBD or against cannabis products below the THC threshold. You can be in possession of as much CBD as you want, as long as you're not selling and the THC percentage is below 0.3%.
What you should know is your CBD products' THC percentage. You can safely own or be in possession of up to 1 ounce of leaf, 7g of concentrates, 16oz of edibles and up to 72oz of marijuana-infused liquids without legal penalty.
What is required to sell CBD in Washington?
Selling CBD is controlled by the LCB, Washington's Liquor and Cannabis Licensing Board. In order to grow or process non-marijuana hemp plants, you must submit a complete business and facility plan with assurances that the license holder will be in control. The business plan and facility plans must be approved and then the license maintained. Regular testing enforces the hemp 0.3% THC requirements.
In order to sell CBD retail, you will need a retail license from the LCB. With a license, CBD oil and other hemp derivative products tested under the limit may be sold as health and beauty items. Your products will need to be tested under the threshold and labeled clearly with both CBD and THC content.
What types of CBD oil can you buy in Washington?
You can buy any type of CBD oil in the state of Washington, provided it has less than 0.3% THC content. CBD oil that comes from hemp plants is cultivated for this low THC content. For this reason, Washington vendors legally sell full spectrum CBD oil, broad spectrum CBD oil, and CBD isolate products.
Due to the recent FDA announcement, CBD edibles and CBD beverages are no longer available. However, CBD tinctures, topicals, and other products are growing the Washington CBD market.
